Copyright User explains what can be ‘borrowed’ from another’s work and distinguishes between inspiration and copying:
“Copyright protects.. the expression of ideas, not the ideas themselves.”
An example is given of two artists who paint the same scene and portray them in different ways. This is fine.
Another example they use is: “the series Lost is copyright protected” but story writers are within their rights to write a story about a group of people who have no choice but to “live on a remote island after a plane crash.”.
In fact one of our founder’s high school teachers wrote a play years ago on this subject, but the story’s narrative and the title were quite different. It is acceptable to take inspiration from the work of another, and this is why we advocate it.
However, as Copyright User states:
“.. create something original.. using your own skill, labour, judgement and effort.”
Using someone else’s work is a copyright infringement if ‘the work as a whole or any substantial part of it’ is copied. At All Bright Club the inspirational gifts are for others to think about their own ways of expressing ideas, events, stories.
Just like the BNC GIFTS® red dragon, others can design their own red dragon (in fact it is highly recommended) but they need to make it look different. Likewise don’t copy our stories, but (if people really want/need to) use can be arranged through an agreement, i.e. a licence.
